2. The petitioner has prayed for bail in connection with Punaura P.S. Case No. 51 of 2025 registered for the offence punishable under Section 64 of the B.N.S. and Sections 4 and 6 of the POCSO Act.

3. The case of the prosecution, in short, is that the petitioner has committed rape with the informant. It is further alleged that a Panchyati was held for solemnizing marriage of the informant and the petitioner but father of the petitioner denied.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

From perusal of the F.I.R., the date of occurrence is 08.03.2025 and the case has been filed on 12.03.2025. It has also been submitted that the petitioner and the informant were having affair and this case has only been filed to pressurize marriage. During course of investigation, medical examination of the victim was conducted and in that examination, doctors have found no sign of rape on the person of the victim and they have opined that the age of victim is 22 years. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 10.07.2025.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the application for bail. Learned counsel for the informant has also submitted that now the informant and petitioner are ready to marriage.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned District
