The petitioner seeks pre-arrest bail in connection with Akorhi Gola P.S. Case No. 160 of 2019, registered under Sections 342, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.

The accusation is that Anshu Kumari, the daughter of the informant had gone in the field to graze the goat, from where Hari Narain Rajwar took away the goat. Thereafter, the informant, Somariya Devi, approached to Hari Narain Rajwar to make complaint, but, she was assaulted through fists and slaps by Hari Narain Rajwar. When her family members, Mithlesh Rajwar, Shankar Rajwar and her husband (Butan Rajwar)

Patna High Court CR. MISC. No.73955 of 2019(2) dt.06-02-2020 2/2 rushed to save her, then, Laxman Rajwar, Lallu Rajwar, Manish Rajwar and Hira Rajwar came taking lathi in their hands and started to abuse and assault.

Submission is that occurrence is said to be of 12.07.2019, but, the present case has been lodged after eight days of occurrence.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Akorhi Gola P.S. Case No. 160 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Dehri, Rohtas at Sasaram, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
