The petitioners are apprehending their arrest in connection with Mahua P.S.Case nO.212 of 2017 registered for offences punishable under Sections 302, 201, 380 and 34 of the Indian Penal Code.
Allegation against the petitioners and other accused persons nine in number is of assault the deceased Sheela Devi and killed her.
Submission of the learned counsel for the petitioner is that the informant is not eye witness this case and the petitioners have been falsely implicated in this case on the basis of suspicion only. It is further submitted that she has not been killed and she is still
Patna High Court Cr.Misc. No.17399 of 2018 (3) dt.01-05-2018 2/2 alive and her son is residing in the village. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and on his surrender he will be released on provisional bail till submission of the charge sheet with condition that they have to co-operate in the investigation and once the charge sheet is submitted and the case is found true against them they will surrender and maker prayer for regular bail, which will be considered by him on the basis of materials available at that time.
