Petitioner was serving as an overseer.

It is submitted that during the entire period of service neither any promotion nor any benefit under Assured Career Progression scheme was granted to the petitioner. He has finally retired on 31.07.2007. Representation has been filed for the said

Patna High Court CWJC No.23553 of 2019(2) dt.31-01-2020 2/2 claim on 21.01.2016. Same is annexure 3 series. None appears on behalf of the State. Counsel for the Accountant General is present.

Petitioner's representation annexure 3 series is yet to be considered by the respondent-authority. Therefore, keeping the same pending would be futile.

In the circumstance, petitioner's counsel submits that a direction may be issued to respondent no.4 to dispose of his claim within stipulated time.

Writ petition is accordingly, disposed of with direction to respondent no.4 (Addl. Secretary, Management Cell, Department of Water Resources, Govt. of Bihar, Patna) to take up final decision on the representation of the petitioner by assigning reason in accordance with law within a period of three months from the date of receipt/production of a copy of this order.
