2. The petitioner apprehends his arrest in connection with Saharsa Sadar P.S. Case No. 503 of 2024 registered for the offence under Section 27, 35 and 25(g) of the Arms Act.
3. As per the prosecution case, some persons are said to have fired in the air and two empty cartridges were also recovered.
4. The petitioner is not named in the FIR and his name has come during investigation.
5. Learned counsel for the petitioner has submitted that the petitioner is named in this case due to enmity. He further submits that the petitioner has no similar case pending against
Patna High Court CR. MISC. No.84176 of 2024(2) dt.03-01-2025 2/2 him and the two cases which are against the petitioner are because of enmity with the agnates and not against the society.
6. Considering the aforesaid facts, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa/concerned Court below in connection with Saharsa Sadar P.S. Case No. 503 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Saharsa Sadar Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U
