JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Dinara P.S.Case No. 144 of 2009 registered under Sections 302, 364, 396, 412 and 201/34 of the Indian penal Code.

Allegation in brief is that dead body of the informant's brother was found thrown by the side of the road and suspicion is raised against one Kush Singh, FIR named accused. Submission is that petitioners are not named in the FIR and charge sheet was submitted against them on 26.08.2015 and they have been implicated merely on the basis of statement of another co-accused Rama Kant Musahar , but no incriminating material has been recovered from the possession of the

Patna High Court Cr.Misc. No.17618 of 2018(5) dt.05-07-2018 2/2 petitioners and petitioner no. 1 has no criminal antecedent and petitioner no. 2 has one criminal antecedent but he was acquitted after trial in that case.

Having considered the aforesaid facts and circumstances, the petitioners, namely, Narad Musahar @ Garad Musahar and Shirati Musahar, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned SDJM, Bikramganj in connection with Dinara P.S. Case No. 144 of 2009.
