2. The petitioner is apprehending his arrest in connection with Jahanabad P.S. Case No. 840 of 2022 instituted for the offences under Sections 420, 423, 467, 468, 471 and 506 of the Indian Penal Code.
3. The prosecution case, in short, is that the accused persons, including the petitioner purchased land on the basis of forged and fabricated document.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. It is a case of civil in nature for which
Patna High Court CR. MISC. No.84355 of 2023(4) dt.14-05-2024 2/2 title suits are pending in the Court below. Moreover, the petitioner has no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case and the fact that the co-accused, who is father of the petitioner, his regular bail was considered by this Court, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
7. The prayer is rejected.
8. However, if the petitioner surrenders and prays for regular bail, the same may be considered by the Court below on its own merit without being prejudiced by this order of rejection.
