2. The petitioner is apprehending his arrest in connection with Aurangabad (Town) P.S. Case No. 592 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(2), 76, 109, 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is of catching hold the hair of the informant and pulled her down, whereupon co-accused Akash Gaurav, Arpit Singh and Anish Gaurav have assaulted her by means of Iron rod and other articles, due to which she sustained a fracture injury on her hand. The accused persons, including the petitioner, have also threatened the informant and others with dire consequences.

4. Learned Advocate for the petitioner referring to the F.I.R. contended that so far the accusation against the petitioner is concerned, the same is only to the extent of catching hold the hair of the informant and pulling down. The allegation of causing assault has been levelled against the other accused persons, who are not before this Court. The petitioner is a man of fair antecedent and submits that on account of some trifle due to throwing of garbage, a scuffle took place, resulting into some unfortunate injuries, however, the petitioner undertakes that he will fully cooperate in the proceeding of the court and would not indulge in such type of activity in future.

5. On the other hand, learned APP for the State vehemently opposes the bail application and submits that the petitioner along with his family members have brutally assaulted the informant, leading to grievous injury.

Having considered the submissions advanced by the learned Advocate for the respective parties and taking note of the nature of accusation levelled against the petitioner coupled with the fair antecedent, let the petitioner, named above, in the event of his arrest or surrender before the court below within four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of

No.81830 of 2025(2) dt.15-12-2025 3/3 Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurabgabad in connection with Aurangabad (Town) P.S. Case No. 592 of 2025, subject to the condition as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the further conditions (i) One of the bailors shall be the own/close relative of the petitioner.

(ii) In case, the petitioner shall be found indulged in intimidating and threatening the informant/witnesses or indulged in such type of activities in future, the informant/State shall be at liberty to file an application for cancellation of the bail of the petitioner.
