Petitioners apprehend their arrest in a case registered under Sections 448, 323, 354(B), 379, 427, 504, 506 and 34 of the Indian Penal Code.
Informant has alleged that on 09.12.2017 at about 8:00 PM when she was in her grocery shop, petitioner No. 1 Ganga Ram Sadai came to purchase some household articles and finding her alone started indecent behaviour and also torn her cloths and when her father-in-law came he was also abused and assaulted by Ganga Ram Sadai who also snatched Rs. 11,000/- from him and thereafter Ram Awtar Sadai and Rabbi Sadai came and also assaulted and abused them and threatened
Patna High Court CR. MISC. No.74087 of 2019(2) dt.21-01-2020 2/2 them to implicate under Harijan Act.
It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case due to previous enmity and business rivalry. It has been further submitted that the wife of petitioner No. 1 instituted a case of similar nature against the informant and his family and present case was filed as a counter blast of said case. Allegations are false and concocted. Petitioners have no criminal antecedents.
Considering the facts and circumstances of the case, prayer of anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, Petitioners are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned court below, in connection with Rudrapur P.S. Case No. 88 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
