2. The instance application for regular bail has been filed by the petitioner in connection with Sessions Trial No.753 of 2021 arising out of Danapur P.S. Case No. 374 of 2020 instituted for the offence u/s 302/304(B)/120(B)/34 of the Indian Penal Code.

3. Earlier the application for regular bail of the petitioner was rejected by this Court vide order dated 9.1.2023 passed in Cr. Misc. No. 39456 of 2022 with a direction to trial court to expedite the trial.

4. It is submitted by learned counsel for the petitioner that the trial has not been concluded as yet and the petitioner is languishing in judicial custody for more than 3.5 years.

5. In pursuance to the direction of this Court, a report dt. 29.1.2024 with regard to the present stage of trial has been received by which it appears that the trial is likely to be concluded within a period of nine months.

6. No fresh ground is made for reconsideration of the regular bail application of the petitioner. Accordingly, this prayer of bail is rejected.

7. The application stands disposed off.

8. However, learned trial court is directed to conclude the trial within a period of six months as the petitioner is languishing in custody since 24.6.2020, failing which, the petitioner may renew his prayer of bail.
