The petitioner apprehends his arrest in Rajpur P.S. case No. 7 of 2018 for the offences punishable under Section 307, 379 and some other Sections of the Indian Penal Code. The informant alleged that he saw the petitioner stealthily taking away fodder from his hut. When the informant raised alarm, the petitioner assaulted him and his son, who came to rescue the informant, with iron rod on his head. The learned counsel for the petitioner submits that there is counter version being Rajpur P.S. case No. 8 of 2018. The injuries found on the person of informant and his son are simple and superficial in nature.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.17901 of 2018 (2) dt.06-04-2018 2/2 allegation made against the petitioner and the fact that scuffle took place between two sides on trivial matter, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Buxar in connection with Rajpur P.S. case No. 7 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
