2. The petitioner seeks bail in connection with C.B.I. Case No. 08/2019 registered for the offences punishable under Sections 120B, 370(A), 376(2)(d) I.P.C. and Sections 5(d), 6 of POCSO Act and Section 75 of J.J. Act.

3. As per the prosecution case, a report was submitted by District Programme Officer Pratibha Kumari Giri regarding irregularities found during a social audit of the short stay home run by NGO Sakhi. Allegations of violence,

Patna High Court CR. MISC. No.82266 of 2025(6) dt.19-03-2026 2/3 misconduct, and mismanagement led to registration of a police case, later transferred to the CBI for investigation.

4. Learned Senior Counsel for the petitioner submits that petitioner has falsely been implicated in the case. It is next submitted that the petitioner has been in rehabilitation of a short stay home and from the statement of the victim girl, it appears that she has assaulted the victim girl and other members of the short stay home who have been tortured by her subsequently. Learned Senior Counsel further submits that she has no criminal antecedent and she is in custody since 17.09.2025. The petitioner undertakes to co-operate in the case/ trial.

Learned counsel for the C.B.I. has opposed the bail application, relying on the statements of the victim girl and other victims who have submitted that the petitioner physically assaulted the victims and facilitated the entry of unknown men for sexual exploitation in the short stay home. It is further alleged that the petitioner accepted illegal payments, providing contraceptive tablets and condoms and threatened the victims to remain silent.

6. Considering the gravity of the offence and the materials available on record, this Court is not inclined to
