JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Samastipur Muffasil P.S. Case No. 510 of 2019 (G.R. No. 1245 of 2019) registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Recovery of 25 liter liquor from a tempo and the petitioner was arrested from there.

Submission of learned counsel for the petitioner is that he is only the driver of the vehicle, having no criminal antecedent and nothing has been recovered from his conscious possession. He is in custody since 17.10.2019 for about two months.

Having heard both sides, in view of the facts and

No.74096 of 2019(2) dt.11-12-2019 2/2 circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions JudgeII-cum-Special Judge Excise, Samastipur in connection with Samastipur Muffasil P.S. Case No. 510 of 2019 (G.R. No. 1245 of 2019), subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
