2. The petitioner seeks bail in connection with Udakishunganj P.S. Case No. 388/2020 registered for the offence punishable under Sections 363/364/302/201/120(B) of the Indian Penal Code.
3. The prosecution case is based on a written complaint alleging therein on 17.12.2020 at about 08:00 A.M. Rajesh Yadav went to garage for repairing his tempo and soon thereafter, he talked to his mother and after that he did not return and his mobile phone was found switched off. It is also alleged that at the same time one Chandan Thakur also talked to the informant. The informant tried to search out her husband but could not find him and she alleged that it is only Chandan Thakur and his wife, who can give the clue of her missing

4. It has been submitted by learned counsel for the petitioner that except suspicion, there is no material against the petitioner. It has come during the investigation that the deceased had gone with the petitioner and subsequently he went further with a girl. On the basis of suspicion, the wife of the petitioner was also arrested. She and other co-accused persons have been granted bail vide order dated 24.08.2022 passed in Cr. Misc. No. 53412 of 2021 and vide order dated 26.11.2022 passed in Cr. Misc. No. 5124 of 2022. The petitioner is in jail since 06.03.2021 and he has no antecedent.

Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VII, Madhepura / concerned Court in connection with Udakishunganj P.S. Case No. 388/2020.
