2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 178, 179, 180 and 61(2) of B.N.S.

3. The case of the prosecution is that from the possession of this petitioner, altogether 75 notes of five hundred currency which is alleged to be counterfeit was recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the alleged currency which has been recovered is not counterfeit rather it is the currency of the petitioner. Learned counsel has further submitted that it is not clear from the FIR or even in

Patna High Court CR. MISC. No.81428 of 2025(3) dt.06-02-2026 2/2 investigation as to how the informant has come to the conclusion that the notes are counterfeit. Moreover, the petitioner is languishing in judicial custody since 20.08.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and has submitted that the said notes were sent to the FSL for report but the report is still awaited. Meanwhile, charge sheet has been submitted. Petitioner is having one criminal antecedent.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Banjariya P.S. Case No. 444 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran Motihari.
