The petitioner has filed the instant application for grant of bail in a case registered for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2016. As per the allegation in the FIR, 14.125 litres of liquor was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that the allegation of recovery from the house is false and concocted, he was not arrested from the place of occurrence, he is in custody since 02.09.2019 and has no criminal antecedent. The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking

Patna High Court CR. MISC. No.74724 of 2019(2) dt.27-11-2019 2/2 into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 6050 of 2019 (arising out of Athmalgola P.S. Case No. 117 of 2019 (District Patna)).
