JUSTICE MADHURESH PRASAD ORAL ORDER 21-05-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are accused in a case registered for offence under Sections 302, 120-B/34 of the Indian penal Code. It is submitted that merely on the basis of confessional statement of co-accused, Bijay Yadav, the petitioners having no criminal antecedent have been made accused in this case. The said Bijay Yadav has been allowed bail in Cr. Misc. No.48022 of 2017. It is also pointed out that the Havildar Lohari Sao, who was accompanying the deceased under trial and who was witness to the occurrence has not identified the petitioners in the

Patna High Court Cr.Misc. No.19073 of 2018 (4) dt.21-05-2018 2/2 T.I. Parade conducted on 14.12.2017. Petitioner is in custody since 20.9.2017.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Bettiah Town P.S. Case No.337 of 2017 on the following conditions : - One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners and The petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
