2. The petitioner apprehends his arrest in connection with Rajepur P.S. Case No. 09 of 2024, registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code and Section-8 of POCSO Act.
3. As per allegation, the accused persons including the petitioner entered into house of the informant and kidnapped his minor daughter for the purpose of marriage.
4. The learned counsel for the petitioner has submitted that the victim, in her statement recorded under Section 164 of the Cr.P.C. has stated that Pintu Kumar enticed away her to Haryana. She was in love and affection with Pintu Kumar for
Patna High Court CR. MISC. No.86967 of 2024(2) dt.21-02-2025 2/2 two years and solemnized marriage with him in Muzaffarpur. He has submitted further that the petitioner has falsely been implicated merely because he is brother of co-accused Pintu Kumar. He has also submitted that on exactly similar footing, co-accused Upendra Rai has been granted regular bail by this Court vide order dated 24.07.2024 in Cr. Misc. No. 26086 of 2024.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th District & Additional Sessions Judge, Motihari, East Champaran in connection with Rajepur P.S. Case No. 09 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
