1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Beur P.S. Case No. 212 / 2022 dated 12.05.2022 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the first information report a total quantity of 05 liters of country made 'mahua' liquor has been recovered from a Bajaj Pulsar motorcycle bearing registration no. BR01BN-4099 and the Police party apprehended two co-accused namely, Pradeep Kumar and Manoj Kumar Chaudhary.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case merely because he happens to be the registered owner of the motorcycle

Patna High Court CR. MISC. No.79571 of 2025(2) dt.03-12-2025 2/2 in question. The arrested co-accused persons had borrowed the motorcycle from the petitioner for the purpose of purchasing medicine from the local market and the petitioner handed over his motorcycle to them in good faith and the co-accused persons committed the alleged offence as stated in paragraph no. 5 of the bail application. The petitioner has no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the justification given by the petitioner regarding alleged recovery of country made 'mahua' liquor and the fact that petitioner has no criminal antecedent, as such, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Spl. Judge Ex. 1, Patna in connection with Beur P.S. Case No. 212 / 2022 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. 2023.
