JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-11-2019 The petitioner seeks bail in connection with Bhojpur Excise Case No. 2065 of 2019, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The petitioner claims to be an auto-rickshaw driver, who has wrongly been arrested for having used his autorickshaw for transporting 140 litres of Indian made foreign liquor, which is said to have been recovered from his auto.

Patna High Court CR. MISC. No.75429 of 2019(2) dt.26-11-2019 2/2 Learned counsel for the petitioner submits that a passenger who had reserved his seat in the vehicle of the petitioner was carrying the aforesaid liquor, but during raid, he could manage to run away and the petitioner was arrested.

The petitioner is in custody since 12.10.2019 and does not have any criminal antecedents.

Regard being had to the facts aforesaid, the petitioner/Ravi Saw @ Ravi Sah is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise ActCum-4th Addl. District Judge, Ara in connection with Excise Case No. 2065 of 2019.

The application stands allowed.
