2. The petitioner seeks bail in connection with Bihar P.S. Case No. 668 of 2024 instituted for the offences under Sections 319(2)/318(4)/338/61(2)/336(3)/340(2)/3(5) of the B.N.S., 2023.

3. As per prosecution case, in course of checking of the candidates in the examination, the petitioner was apprehended appearing in the examination in place of real candidate namely Vivek Kumar at the examination centre i.e. P.M.S. College, Paharpura, Biharsharif, Nalanda.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.83732 of 2024(2) dt.10-12-2024 2/3 the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. There is no independent witness who has supported the prosecution case. The petitioner is a student of B.A. and non-grant of bail will jeopardize the future career of the petitioner. The petitioner has no criminal antecedent and is languishing in judicial custody since 29.08.2026 without any rhymes or reason.

5. Learned counsel for the petitioner again submits that the co-accused namely Vivek Kumar has already been granted bail by this Court vide order dated 03.12.2024 passed in Cr. Misc. No. 81508 of 2024.

6. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged against the petitioner is serious in nature and, hence, he does not deserve bail.

7. Having heard rival contention of both the parties

No.83732 of 2024(2) dt.10-12-2024 3/3 and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner and the petitioner having no criminal antecedent, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bihar P.S. Case No. 668 of 2024.
