2. Counsel for the State submits that vide order dated 06.04.2018, liberty was granted to the petitioner to file rejoinder within two weeks, but he has not filed it yet as it transpires from Office note dated 19.09.2023.

3. On earlier occasion i.e. on 26.09.2023 matter was adjourned for three weeks to file rejoinder to the counter affidavit.

4. Counsel for the State submits that yesterday also this case was passed over due to this reason.

5. It transpires to this Court that petitioner is not interested to pursue this matter.

6. Accordingly, this application is dismissed due to

Patna High Court CWJC No.5407 of 2018(4) dt.23-01-2024 2/2 non-prosecution.
