Petitioner is apprehending his arrest in connection with Kankarbagh P.S. Case No.108 of 2023, registered for the offence punishable u/s 307/34 of the IPC and 27 of the Arms Act and subsequently section 302 of the IPC was added. 3.
Allegedly, two persons came at the venue of the marriage ceremony of the informant's side and made indiscriminate firing from pistol which hit two people including the brother of the informant, who died in course of treatment.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case due to ulterior

Petitioner is not named in the F.I.R. and his name transpired during investigation on the statement of one apprehended co-accused, who alleged that the said country made pistol was supplied by the petitioner. The allegation of firing upon the deceased is against Bittu Yadav. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.
Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
