2. The petitioner is in judicial custody in connection with Udwantnagar P.S. Case No. 235 of 2024 for the offences punishable under Sections 366-A and 34 of the Indian Penal Code, lodged on 11.06.2024 by the informant, Rubi Devi.
3. As per the prosecution story, the informant alleged that she is related to Manoj Pandey whose wedding was on, her daughter went to attend it and allegation is that this petitioner took her away along with jewellery of her mother. The informant alleged the involvement of all the family members who wanted to grab the jewellery.
4. It is the case of the petitioner that prior to the present case, a case was already lodged by the petitioner's side
Patna High Court CR. MISC. No.84666 of 2024(2) dt.12-12-2024 2/3 alleging that he has been taken by the informant side. The further submission is that the girl subsequently returned and she has not narrated anything against this petitioner. In fact, she herself stated that the girl is in relationship with the petitioner. The last submission is that he is in custody since 16.07.2024 having no criminal antecedent.
5. Mr. Jitendra Kumar Singh, learned APP for the State opposes the prayer submitting that allegation is that he has taken away the daughter of the informant.
6. Considering the submissions put forward by the parties as also the fact that there is a counter case prior to present case, the petitioner is a young boy of twenty years, the girl has not narrated anything against him, is in custody since 16.07.2024, this Court is inclined to extend him the privilege of bail.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Udwantnagar P.S. Case No. 235 of 2024, subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official

(ii) the petitioner shall appear on each and every date before the Trial Court failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his attendance;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds. (Rajiv Roy, J) vinayak/- U T
