2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

3. As per allegation in the FIR, informant works in Micro Finance Ltd. And on 22.6.2023, he was returning to his branch after collection money and in the way some unknown miscreants looted his entire amount of Rs. 83,610/-, Samsung Tab and some documents from his motorcycle and fled away.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Neither the petitioner is named in the FIR not put on TIP. There is no eye witness of the alleged occurrence. Nothing has been

No.84931 of 2023(2) dt.15-01-2024 2/2 recovered from conscious possession of the petitioner, His name surfaced in this case on the basis of confessional statement of co-accused Tejeswi Rai. Petitioner has got no criminal antecedent and languishing in judicial custody since 2.9.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sadar Motihari, East Champaran in connection with Pipra P.S. Case No. 194 of 2023.
