The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 342, 323, 307 and 365/34 of the Indian Penal Code.

Allegation against the petitioner along with accused persons is of assaulting the informant by bat, rod, hammer and fists and slaps.

Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence rather he has been falsely implicated in this case. As per FIR, informant and his colleague Anil Singh killed Amaresh Kumar Singh, who is own brother of the petitioner for this one case was lodged against the informant and Anil Singh. On the alleged date of occurrence, the informant and his colleague wanted to flee away, in the meantime, petitioner caught them at Zero Mile, Sheohar with the help of local

No. 77717 of 2019(4) dt.06-03-2020 2/2 persons and were going to hand over to the police, in the way, the police reached on the information of petitioner and took in custody. It further submits that there is general and omnibus allegation hence offence u/s 307 is not made out against the petitioner. The injury is simple in nature and the petitioner has got no criminal antecedent.

On perusal of the case diary at para-23 as per supervision of S.D.P.O., Sheohar the case was found true only under sections 147/149/341/342/323/357/34 of the I.P.C. and as per case diary, the injury report is simple in nature. In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S.
