Petitioner, already in custody, seeks bail in connection with Silao P.S. Case No.31 of 2018 registered under Sections 379/353 of the Indian Penal Code, Sections 4, 5, 6, 7 of the Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003 as well as under Sections 4/40 of the Bihar Minor Mineral Concession Rules, 1972.

Allegation in brief is that stolen sand was being carried by the accused persons and the driver succeeded in fleeing away but trolley was apprehended by the police. Learned counsel for the petitioner submits that the petitioner was coming after treatment and he is the brother of the driver, however learned counsel for the State submits that

Patna High Court Cr.Misc. No.21010 of 2018(2) dt.11-04-2018 2/2 the petitioner is not the brother of the driver rather he is the brother of the owner of the tractor.

Having considered the said facts and circumstances, the prayer of bail of the petitioner is presently rejected in connection with Silao P.S. Case No.31 of 2018 pending in the court of learned CJM, Nalanda at Biharsharif. The petitioner may renew his prayer of bail after framing of the charge.
