The petitioner seeks regular bail in connection with Riga P.S.Case No.135 of 2019 instituted for the offences punishable under Section 302/34 of the Indian Penal Code. There is no eye witness of the occurrence of murder of the father of the informant. However, suspicion is there against the petitioner due to dispute between the parties for purchase of a piece of land. Petitioner has stated on oath that he has got no criminal antecedent. Petitioner is in custody since 20.09.2019. Investigation of the case is already complete. Learned counsel for the informant opposed the prayer for bail.

Considering the fact that there is no material against

No.81464 of 2019(2) dt.13-01-2020 2/2 the petitioner and there is no allegation that the petitioner is going to tamper with the evidence or abscond the process of law, let the above named petitioner be released on regular bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sitamarhi/Successor Court in connection with Riga P.S.Case No.135 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and also that the petitioner shall not leave the country without permission of the Court.
