JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-11-2019 The petitioner filed this writ application under Article 226 of the Constitution of India for issuance of a writ of mandamus direction the District Magistrate, Banka (Respondent No.3) to dispose of Anganbari Appeal No. 03 of 2019 filed by the petitioner against the order dated 02.03.2019 of District Programme Officer, Banka in Miscellaneous Anganbari Case No. 32 of 2018-19.

Submission is that while petitioner was at serial No. 1 in the merit list for selection at the post of Anganbari Sevika for Anganbari Centre No.153, village-Gurudwar, Ward No.4, Block-Barahat, but the Selection Committee selected

Patna High Court CWJC No.23583 of 2019(2) dt.29-11-2019 2/2 Ajanta Kumari, whose name was found at serial No.2. The petitioner raised her grievance against the selection of Ajanta Kumari as Anganbari Sevika and filed Miscellaneous Anganbari Case No. 32 of 2018-19 before the District Programme Officer, Banka, which was dismissed on 02.03.2019 and the said order has been challenged by the petitioner by filing Anganbari Appeal No. 03 of 2019 before the District Magistrate, Banka (Respondent No.3), but the said appeal is pending since long for disposal.

Having regard to the facts and circumstances of the case and submission of the parties, the District Magistrate, Banka (respondent No.3) is directed to dispose of the Anganbari Appeal No. 03 of 2019 filed by the petitioner within two months from the date of receipt/production of a copy of this order.

With the aforesaid observations and direction, this writ application is disposed of.
