For the Petitioner/s :
Mr. Shashikant, Advocate For the Opposite Party/s :
Mr. Bharat Bhushan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 12-05-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending arrest in connection with Complaint Case No. 240 of 2020, for the offences punishable under Sections 406, 419 and 420 of the Indian Penal Code.
3. As per the prosecution, a complaint case has been
Patna High Court CR. MISC. No.84886 of 2024(4) dt.12-05-2025 2/3 lodged stating that the mother of the complainant died on 06.03.1990, leaving behind her only heir. However, three years after her death, the accused persons executed a deed by falsely showing the complainant's mother as alive.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel further submits that the present case has been falsely lodged, and if the baksishnama is incorrect, the same should be challenged before the competent Civil Court. Counsel also submits that the criminal antecedents of petitioner Nos. 1, 2, and 3 are clean, whereas against petitioner No. 4, there is one criminal case pending, in which he is on bail and the matter has been dismissed under Section 203 of the Cr.P.C.
5. Learned counsel for Opposite Party No. 2, appearing after notice, submits that from the contents of the complaint petition, it is crystal clear that the accused persons, after the death of the complainant's mother, executed a baksishnama in the year 1993 by presenting a fake lady as the deceased.
6. Learned APP for the State opposes the prayer for bail and submits that fraud is apparent from the complaint petition.
Patna High Court CR. MISC. No.84886 of 2024(4) dt.12-05-2025 3/3
7. In the present facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioners, therefore the bail application of the petitioners is hereby rejected.
