JUSTICE PARTHA SARTHY) 07-01-2025 The instant appeal under Clause 10 of the Letters Patent of this Court has been preferred against the order dated 13.10.2023 passed in Civil Miscellaneous no. 797 of 2017 which was an application under Article 227 of the Constitution of the India.

2. The office has raised an issue with respect to the maintainability of the appeal, in view of the judgment of this Court in the case of Nirmal Tiwary vs. State of Bihar & Ors. [2013 (1) PLJR 800].

3. Having heard learned counsel for the parties and having perused the records of the case, in view of the judgment in the case of Nirmal Tiwary (supra), this appeal is held to be not maintainable.

4. The appeal is dismissed.
