1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 87 of the BNS, 2023.

3. In compliance of the order dated 10.12.2025, the SHO and the Investigation Officer of the case are present in the Court.

4. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that his wife Sangeeta went missing on 14.03.2025, during search, it transpired that she was in regular touch with a person having mobile number 9162461837 who was identified as petitioner, accordingly, the informant went to the house of the petitioner to enquire when he was assaulted by the petitioner.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the

Patna High Court CR. MISC. No.80459 of 2025(3) dt.17-12-2025 2/2 informant, it is next submitted that victim came back and her statement was recorded under Section 183 BNSS wherein she has not alleged anything against the petitioner.

6. Learned A.P.P. for the State also based on instruction submits that statement of the victim was recorded under Section 183 BNSS wherein she has not taken the name of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dhoraiya P.S. Case No. 115 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

8. The personal appearance of the SHO and the Investigating Officer of the case is dispensed with.

9. Accordingly, the instant anticipatory bail application is allowed.
