The petitioner is apprehending his arrest in connection with Turkauliya P.S.Case No.783 of 2017 registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 427, 448, 504, 506 of the Indian Penal Code. Allegation against the petitioner is of assault to the informant causing injury to him.
Submission of the learned counsel for the petitioner is that allegation is general and omnibus, however, the learned counsel of the petitioner has fairly submitted that the petitioner is accused in six other cases also though he is on bail in all those cases. Heard learned A.P.P. also.
Having heard both sides and in view of allegation coupled
Patna High Court Cr.Misc. No.20018 of 2018 (2) dt.25-04-2018 2/2 with the fact that he has criminal incident, I am not inclined to grant bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered on its own merit without being prejudiced by the order of this Court.
With the aforesaid direction, this application is dismissed.
