2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 and 120B/34 of the Indian Penal Code.
3. The case of the prosecution is that on 28.06.2024 at about 1:00 P.M. in the evening, the son of the informant namely, Piyush Kumar had went to attend Ram Dhuni in the village. However, at about 2:00 A.M. in the midnight , when the informant woke up, he found that his son has still not returned then the informant started searching him. The informant received information by the co-villagers that the dead body of his son was laying near river 'Chinawari'. Hence, the present FIR.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case on mere suspicion. It is further submitted that during the course of investigation certain persons have given their confession but nothing has come against the petitioner to implicate him in connection with the present case. Moreover, the petitioner is languishing in judicial custody since 30.06.2024
5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has one criminal antecedent.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Laxmipur P.S. Case No. 219 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui/concerned Court.
