The petitioner seeks bail in connection with Nautan P.S. Case No. 259 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 379, 307, 354(B), 504 and 506 of the Indian Penal Code.
The petitioner and co-accused Sheikh Kawal are said to have assaulted Sheikh Babujan, Sheikh Bhola and Sheikh Sahid by means of farsa making them injured. Out of them, Sheikh Babujan succumbed to his injury.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has no concern with the aforesaid occurrence. The allegation levelled against the
Patna High Court Cr.Misc. No.19232 of 2018(3) dt.18-05-2018 2/2 petitioner is not specific rather omnibus. There is case and counter case between the parties. There is land dispute between the parties. Though, the petitioner and Sheikh Kawal are said to have assaulted aforesaid three persons, but it is not ascertained as to who assaulted whom. The petitioner has no criminal antecedent. He has been languishing in custody since 3.07.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIth, Bettiah, West Champaran in connection with Nautan P.S. Case No. 259 of 2017.
