1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 354, 354(C), 504 and 506/34 of the Indian Penal Code as well as Sections 8 and 12 of the POCSO Act.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant. It is further submitted that the date of occurrence is 07.01.2023 and the FIR came to be instituted on 12.01.2023 i.e. after delay of five days without any plausible explanation. It is next submitted that the informant instituted the case alleging that petitioner acted inappropriately and showed his naked body to the victim girl. It

No.84111 of 2023(4) dt.27-06-2024 2/2 is also submitted that petitioner is a bank employee and the statement of Deepak Kumar was recorded by the police during the course of investigation under Section 161 Cr.P.C. wherein he has not supported the case of the prosecution. It is further submitted that there is a dispute in between the family of the petitioner and the informant with respect to the land.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with East Champaran Sadar Mahila P.S. Case No. 03 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
