JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-08-2022 Though the present writ petition has been filed for quashing the notice dated 14.03.2018, issued by the Circle Officer, Sikandra (Jamui) i.e. the respondent no. 7, by which the petitioner has been asked to remove the encroachment made over the land appertaining to thana no. 109, Khata no. 311, Khesra no. 561 at Mauza Lachchuad but the learned counsel for the petitioner has limited his prayer to grant of liberty to the petitioner to file his objections/ show cause in the on-going Encroachment case no. 10 of 2017-18 as also issuance of

Patna High Court CWJC No.5546 of 2018(3) dt.01-08-2022 2/2 direction to the respondent no. 7 to consider the documents to be filed by the petitioner as also the show cause reply to be filed by the petitioner and thereafter, pass appropriate final orders under Section 6(1) of the Bihar Pulic Land Encroachment Act, 1956. Accordingly, the present writ petition stands disposed off, however with liberty to the petitioner file objection/ show cause, within a period of four weeks from today, in the aforesaid Encroachment case, before the respondent no. 7, whereafter the respondent no. 7 shall pass appropriate orders under Section 6(1) of the Bihar Pulic Land Encroachment Act, 1956. It is needless to state that till the final order is passed by the respondent no. 7, status quo existing as on today, shall be maintained.
