====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 120(B), 302 and 328 of the Indian Penal Code.
3. As per the prosecution case, the brother of the informant consumed Tadi (Toddy) along with the petitioner and other co-accused persons, and thereafter, he died.
4. Learned counsel for the petitioner submits that the petitioner is one of the persons who consumed Toddy with the deceased. Co-accused persons Sheru Khan @ Md. Aslam Khan and Bhuwar Khan, having similar and identical allegations, have already been granted bail by this Court vide orders dated 04.11.2025 and 12.05.2025. The petitioner is in custody since
Patna High Court CR. MISC. No.84343 of 2025(2) dt.04-12-2025 2/2 08.09.2025 and the charge-sheet has been submitted in this case.
5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Bhojpur at Ara, in connection with Piro P.S.
