JUSTICE BIRENDRA KUMAR ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Section 376 of the Indian Penal Code and Section 4 of the POCSO Act.

According to First Information Report, the petitioner allegedly ravished to the daughter of the informant at a lonely place.

It appears that trial is going on. The informant or the victim have not supported any allegation against the petitioner vide their deposition at Annexure-2 series.

In that view of the matter, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/-

Patna High Court Cr.Misc. No.19814 of 2018 (2) dt.11-04-2018 P2/ (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with POCSO Case No.17 of 2016, arising out of Puraini P.S. Case No.110 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
