JUSTICE BIRENDRA KUMAR ORAL ORDER 16-03-2020 Heard learned counsel for the petitioner and learned APP for the State as well as learned counsel for the informant. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the I.P.C and Section 27 of the Arms Act.

Petitioner is assailant of the deceased. He is in custody since 17.06.2019.

Learned counsel for the petitioner has referred to paragraph No.110 of the case diary for his submission that not this petitioner rather one Praduman Yadav had caused firearm injury and death of Pintu Yadav.

The aforesaid paragraph is opinion of the police without mentioning name of the witness who stated so to the police.

No.75080 of 2019(4) dt.16-03-2020 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on bail in connection with Bhabhua P.S.Case No.329 of 2019 pending in the court of learned C.J.M., Bhabhua.
