The petitioner is in custody since 11.12.2017 in connection with Delha P.S. Case No. 199 of 2017 for the offence registered under Sections 302/201 of the Indian Penal Code. Learned Senior counsel for the petitioner submits that save and except suspicion which arose on account of strained marital relationship between the deceased and the petitioner, there is no further material in the case diary to implicate the petitioner in connection with the present case.

Learned counsel for the State, after perusal of the case diary, submits that there is a statement of independent witness which would indicate that there had been quarrels between the

Patna High Court Cr.Misc. No.19709 of 2018 (3) dt.02-05-2018 petitioner and the deceased lady as the petitioner suspected that the deceased had illicit relationship with other person. It is further submitted that the post-mortem report also indicates that the death was on account of asphyxia by pressing of the neck and the body was found in a sack near the house of the present petitioner. Having heard learned counsel for the parties and the materials available in the case diary, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected. However, the petitioner will be at liberty to renew his prayer for bail after framing of charge.
