Petitioner apprehends his arrest in connection with Chakmehsi P.S. Case No. 111 of 2017, registered for the offences punishable under Sections 420, 467, 468, 469 and 120B of the Indian Penal Code.

Allegation against the petitioner, who happens to be Upmukhiya of Malinagar Gram Panchayat, is of taking fake examination in collusion with other accused persons and of collecting huge amount from the students.

Submission of learned counsel for the petitioner is that he was not Upmukhiya of Malinagar Gram Panchayat and the allegation is against one Mahesh Kumar.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that material shows that

Patna High Court Cr.Misc. No.19659 of 2018 (3) dt.11-05-2018 2/2 petitioner has also hand in conducting the fake examination. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit.
