For the reason of the petitioners having been noticed by the police in this matter under Section 41 of the Cr.P.C. and the matter being very old where cognizance has been taken way back in the year 2014 and bailable warrant of arrest having been issued against the petitioners for their appearance, I am not inclined to grant anticipatory bail to them.

Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioners appear before the court

No.75880 of 2019(6) dt.06-05-2022 2/2 below and seek bail, their application shall be considered on its own merits, taking into account that during all this while, the petitioners had never misused the privilege of interim reprieve of no arrest by the police in the matter.
