The petitioner is accused in connection with Basopatti P.S. Case No. 248 of 2019, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that in course of patrolling duty, some persons were seen with three motorcycles. On seeing the the police party, all started to flee away leaving their motorcycles, but on chased, two persons were apprehended, who disclosed their names as Sheoshankar Yadav and Anand Kumar Yadav (petitioner). On search of the motorcycles, 665 litres Nepali Soufi, kept in different bottles were recovered, out

Patna High Court CR. MISC. No.74123 of 2019(3) dt.06-03-2020 2/2 of which, 90 litres Nepali Soufi, kept in the different bottles, was recovered from the motorcycle of the petitioner. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 01.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani, in connection with Basopatti P.S. Case No. 248 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
