The petitioner seeks bail in connection with Pasraha P.S. Case No.125 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act (Amended), 2018.

Learned counsel for the petitioner submits that there is recovery of 629 liters of Indian made foreign liquor from village Barmasiya Mushari near B.N. Bandh of East in Bhuskhar of Sanjay Kumar Thakur (petitioner). Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and he further submits that the petitioner has got no criminal antecedent which is

Patna High Court CR. MISC. No.77857 of 2019(2) dt.02-12-2019 2/2 mentioned in paragraph-3 of the bail petition. Petitioner is in jail custody since 23.09.2019.

In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of Rs.25,000/- in the court below/Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II-cum-Special Juge, Khagaria in connection with Pasraha P.S. Case No.125 of 2019.

Such deposit of Rs.25,000/- shall abide by the outcome of the criminal case.
