Learned counsel for the petitioner submits that during pendency of the writ petition, from the documents, it has been unearth to the petitioner that separate cause of action has been developed in this case and he become entitle for payment of his arrear for promotion to the post of the District Prosecution Officer in the Grade Pay of Rs. 8,700/-.

3. Learned counsel for the State submits that what petitioner has pleaded in the writ petition and what relief he has demanding today on the day of final argument are mismatched.

4. In this background, the present writ application

3) is directed to consider the claim of the petitioner afresh and shall pass reasoned and speaking order and if it has been found that petitioner is entitled for the relief as per his fresh representation, he shall grant the relief within the said period of 90 days.
