No. 5145 of 2022, this Court, by an order dated 11th of September, 2024, while disposing of the writ petition, directed the Director, Department of Science and Technology, Govt. of Bihar, Respondent No. 3, to revisit the appropriate scale of the petitioner's pension in the light of the notification dated 12th of August, 2024. The Director, Department of Science & Technology, Govt. of Bihar, has revisited the said order in compliance with the direction passed by this Court and came to a finding that the petitioner is not

Patna High Court MJC No.4158 of 2024(3) dt.24-01-2025 2/2 entitled to get any increment for obtaining his PhD degree. Thereafter, the petitioner has approached this Court in contempt. When the Respondent No. 3 already decided the issue as per the order of this Court, denying the petitioner's claim, no contempt shall lie against the Respondent No. 3 for non-compliance with the order passed in the writ petition.

2. If the petitioner is aggrieved, he can file fresh writ petition before this Court.

3. The instant contempt application, being devoid of any merit, is dismissed.
