2. The petitioner seeks bail in a case registered for the offence under Sections 20(b), 22 of the N.D.P.S. Act.

3. 12 Kg. of Ganja has been recovered from a Scorpio and this petitioner was found sitting in the said vehicle.

4. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. Petitioner is neither owner nor driver of the vehicle in question and has got no concern with the alleged recovered Ganja. Petitioner was simply a co-passenger. The alleged Ganja is less than commercial quantity. In this case, chargesheet has already been submitted. Petitioner is in custody since 05.10.2023.

5. However, learned A.P.P. for the State opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS) cum 1st Additional Sessions Judge, Aurangabad (Bihar) in connection with Aurangabad Excise P.S. Case No. 771 of 2023.
