2. The petitioner apprehends her arrest in connection with Bhagwanganj P.S. Case No. 35 of 2023 instituted for the offences punishable under Sections 302, 120(B) and 201/34 of the Indian Penal Code.
3. As per the prosecution case, all the FIR named accused persons murdered the son of the informant.
4. Learned counsel for the petitioner submits that petitioner is innocent has committed no offence and has falsely been implicated in this case He further submits that the petitioner is a lady and is cousin mother-in-law of the deceased and due to suspicion all the in-laws of the deceased has been

He next submits that petitioner has nothing to do with her Devar Binay Thakur and family division among brother of Binay Thakur about seven years earlier to this occurrence. He lastly submits that there is no eye witness of the occurrence. Petitioner has been made accused only on the basis of confessional statement of co-accused Binay Thakur. Petitioner has got clean antecedent as stated in para 3 of the petition.
5. Learned APP opposes the prayer for bail.

From perusal of the FIR and the impugned order of the learned Additional Sessions Judge-II, Masaurhi, Patna dated 02.09.2024, it appears that on the basis of written report of the informant Panjabi Thakur @ Raj Kumar Thakur, FIR has been registered under Sections 302, 120(B) and 201/34 of the Indian Penal Code against five co-accused persons including the present petitioner. It is further submitted that petitioner is a lady and she is aunt of the husband of the deceased. From perusal of the postmortem report, it also appears that there is no any external injury found on the body of the deceased and petitioner is a lady, so considering all these aspects let the petitioner above named in the event of her arrest or surrender before the Court below within six weeks from today, be released on bail
