2. The petitioner apprehends his arrest in Kalyanpur P.S. Case No. 131 of 2023 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018, pending in the Court of learned Exclusive Special Excise Court No. 3, East Champaran at Motihari.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.86145 of 2023(2) dt.18-01-2024 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that one of the co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court and the petitioner has no criminal antecedent.
